COMMISSION ON "SWAPS." By Telegraph.—Press Association. Christchurch, Yesterday. In the course of a judgment on a claim for commission arising out of an exchange of properties, Mr. Bailey. S.M., said the general trend of the law was to discourage persons acting as agents for both parties to transactions, and an agent could not receive commissoin from both parties. In the case of an exchange a person -might claim to be an agent for the two vendors, but there would be conflicting interests, and the principle must be maintained that an agent could not act for both parties without the fullest disclosure and consent of the parties. The onus lay on the agent to prove such disclosure and consent. WELCOME RAINS. Christchurch, Yestevday. Rain fell this morning in North Canterbury for several hours, and will freshen up the pastures. There has teen no rain of consequence in this district since the first week of September, and the outlook, especially on light lands, had become serious. The rain that has now fallen is insufficient to save the situation, but the weather continues dull, with promise of further showers. A NELSON GRIEVANCE. Nelson, November 14. A serious position has arisen over the Maitai Valley and access to the river banks, which people have enjoyed ever since Nelson was found. The" legatees of the Richardson estate, who hold the grant of the whole valley, intend fencing it off, so that it will' be practically closed to the public. The City Council carried an urgent resolution asking Messrs. R. McKenzie and Graham and the city members to induce the Government to resume the Richardson estate or acquire the whole area a scenic reserve. Much public money in reading and bridging has been spent in the valley. and the citv has a waterworks reserve at thp other end which might cause complications.
