AX APPEAL DISMISSED. By Telegraph.—Press Association. Wellington, November 11. Air. Justice Chapman to-day delivered judgment in an appeal from a decision of Air. W. Pv. llaselden, S.M.. in an action arising out of the purchase of machinery: Appellants were Ellis and Burnand, Ltd., timber merchants. Hamilton, and respondent Norman fiibbs, Wellington, liquidator of the Palmer Engineering Co., Ltd. Appellants ordered from the Palmer Engineering Company a machine for printing brands on butter boxes. It was to be like one thev had previously obtained from the same firm. The machine supplied had a larger cylinder than the previous one, and consequently new brands had to be made. The invoice price of machine was £l2l 14s, and half that amount had been paid, leaving £OO 17s in dispute. Appellants were kued foi £<io 17s. and then counter-claimed for that amount for damage and breach of warranty. The magistrate gave judgment for plaintiff on the claim for £Cii: 17s a7id costs, and for defendants on the counter-claim for £l9 10s and costs. After referring to the correspondence and evidence in detail. His Honor dismissed the appeal with eight guinea? costs.
