AN IMPORTANT JUDGMENT. By Telegraph.—Presv Association. Nelson, Last Night. A judgment of importance to borough councils was given to-day by Mr. J.j S. Evans, S.M., in a case where the city council proceeded against a carter for unlawfully removing gravel from the bed of a stream, the contention being that the corporation owned the fee simple in the stream by reason of a street on the banks. The Magistrate, after reviewing the authorities, held that it was very doubtful whether the presumption applied to a street, and if it did it was rebutted by the fact that parts of the original bed immediately above and below the locus hi quo left dry. by the erosion, were vested in the corporation by a special Act of Parliament. The information was dismissed.
