PREFERENCE TO UNIONISTS
IMPORTANT MAGISTERIAL I RULING. By Cable. Press Association.— -Copyright Mr b. E. McCarthy, S.M., gave received judgment to-day in a case of interest to Labour Unions. A local linn of contractors employed a driver, who wa.s not a member of a union, while unionists were available and were willing to undertake work; and were lined some time ago for that breach of the award. They kept the man on, however and the Inspector of Awards now brought an action against the firm alleging a further breach. ' The magistrate held that the offence of not giving preference to a unionist was complete. Directly a non-uniouist was employed, and in absence of any provision in the award making the offence a continuous one and of any breach iin the continuity of employment, the offending employers could only be proceeded against for ,one penalty, notwithstanding continuance of a non-unionist in their employment. The case was therefore dismissed with costs.
