Dunedin, Last Night. In the Magistrate's Court to-day the Inspector of Factories proceeded against George Moody, hairdresser, on a charge of failing to allow a full holiday to an assistant on June 3. Counsel for the defence said the assistant was a casual hand, working from day to day, and on June 3 worked from 8 till 11 a.m. He also, raised the defence that a holiday should be given on the day of observance, and as there had been no observance this year there had been no offence. The Magistrate held that the proper day of observance wa9 Anniversary Day, and, in'reply to counsel, said that if the birthday fell on Sunday its observance would not be obligatory. The point raised with reference to the position of an assistant was a difficult one, and .he would reserve iu-ignicnt.
