CHARGE OF MURDER
POWELKA BEFORE THE SUPREME COURT. WHO FIRED THE FATAL SHOT? By Telegraph—Press Association. Palinerston N., Last Night At the Supreme Court to-day Powelka was charged with the murder of Sergeant Maguire. The evidence for ibe Crown was similar to that of the lower Court. Under cross-examination, Hampton owner of the house whereat the tragedy occurred, .said he only judged from the walk and peculiarities of action that the man 'he saw enter his ground wa.v Powelka. He would not swear it was. Detective Quartermain, cross-examined at length, said that if he thought there was a possibility that his was the fatal shot he would have said so. The ammunition he had with him was borrowed from a Wellington man, who lent him a revolver. It was all he had with him. He had not, purchased any at Palmerston since the tragedy. Mr. Moore, accused's counsel, stated he intended to call evidence that Quartermain. had' purchased some ammunition at Palinerston on the day following the tragedy. Mr. Martin deposed that a blow trom a handcuff, such as Maguire stated he had struck his assailant, would leave a bruise for ten days. The case is expected to last several days), and meanwhile the jury is locked up.
