APPEAL COURT.
TRUTH CONVICTION UPHELD. By Telegraph —Press Association. Wellington, April 13. At the Court of Appeal, before Sir Robert Stout and Justices Williams, Edwards and Chapman, the case Rex v. Coburn, a case reserved for the opinion of the Court by Justice Chapman, was heard. Accused was in November last indicted at Wellington under section 157 of the Crimes Act for the offence of knowingly distributing for public sale certain obscene printed matter tending to corrupt morals, to wit copies of Truth. Accused was' at the time the alleged manager of Truth in Wellington. He was found guilty by a jury, Judge Chapman deferred sentence and reserved for consideration of the Court of Appeal the following: Whether there was any evidence to -support a conviction; whether it was necessary, seeing accused was manager, to prove he knowingly distributed the matter complained of, whether the conviction was right. Messrs. Levi and Dunn appeared for the accused, and Mr. Myers for the Crown.
The Court unanimously gave judgment affirming the conviction.
