APPEAL COURT.

I A CONVICTION QUASHED. By Telegraph.—Press Association. Wellington, Friday. The Appeal Court to-day gave judgment in tlic case Rex v. MeCann Brown. Tlie point was whether a judge* could comment on the refusal of I "prisoner to give evidence in his own ireiencc. Separate judgments were delivered by each of the five judges who heard the case. Mr. Justice Williams, Mr. Justice Denniston, and Sir. Justice Cooper held that a judge could not comment. Mr. Justice Edwards and Mr. Justice Chapman gave dissenting judgments. The conviction was therefore quashed by a majority. The Court adjourned till February 1.
