The Privy Council has grai; I power to appeal from the Native Appellate Court's decision in llie me Tainui tribe against the Kguli-iuii Hpt ti•'•.«. The ease relates to the Xi Akau block, north of Raglan, owned ny the two tribes—the Tainui and the Ngatitahinga. In 1801 the Native Land Court, presided over by Colonel Trimble, partitioned the block, and in doing to adhered to the original tribal boundary. The Tainui tribe obtained a re-hearing | and the re-hearing court altered the tribal boundary bo as to give the Tainui tribe some 13,000 acres' more than they could have been entitled to had the tribal boundary been adhered to. in 1004 the Governor appointed a commissioner to enquire into the matter, and in 1000 legislation was passed givliji jurisdiction to the Native Appi-Hawf Court to review the previous defutien*. The appointed court restored the ancient tribal boundary, practically confirming the decision of the Maori Land Court which sat in 1801. I'll" roalt«r came before the Court of Appeal in 1007, and that Court ref.ned to interfere with the decision of the Aimellate Court. The question at issue is whether the effect of the confiscation under the New Zealand Settlements Act, 1803. was to extinguish the Maori customary title,.
