Schwaum, claim £8 for potatoes and tank left on farm sold by plaintilf to defendant.. Defendant counter claimed £0 18s or labor. Air. Townscnd for plaintill', and Air. Wilkes lor defendant. His Worship gave judgment for the £B, and non-suited Schwann! on his counter-claim; costs against defendant in the main claim amounted to £4 13s, and on thc counterclaim 21s. W. Jenkinson and Co. v. Walter Williams, claim £ls 2s !kl. Mr. Wilkes for plaintilf and Air. Townseml for defend ant. It was explained that the claim had been settled with the exception of an amount of £2 10s for a cushion made for defendant's phaeton. A coun-ter-claim for £2 for return of old material from the cushions wns heard at the same time. After evidence on both sides had been given, the Magistrate said the onus was on thc defendant to show there had been an excess contract, and he had not fulfilled the obligation. It seemed that C 4 was a fail price for the work, and judgment would lie given the balance of Xi Ids owing on the claim. Although bis Worship did not think plaintilf did right in cutting up the cushion without permission, yet Williams did not seem to have demanded bis goods back, and so he would have to be nonsuited with costs. The rosts in the original claim were 31s.
