Mr. Kettle, S.M., gave his reserved decision at Auckland last Thursday in the case A. J. Canning v. William Gruar, a claim of £137 10s for 500 shares, calls paid, and interest. Defendant, who wall sharebroker and jobber, admitted that he bought shares n ot only for customers but for himself. He admitted that be put the shares of his ilient in his own name, without specifying the numbers of the shares, contrary to section 29 and section 100 of the Companies Act. Defendant also admitted that he had taken transfers in blank, leaving tiic secretary of the company to fill in an* numbers. This, said the Magistrate, was most irregular and dangerous. Da fendant purchased 500 Champion sharas in July, 1008, for plaintiff, at 4s 8d each. Four hundred were numbered, and lnO from himself were, unnumbered. Apparently he held these shares in trust for plaintiff. The Court was not satisfied that such an arrangement took place. On 9th and 10th Octobel defendant sold 500 Champion shares, which, in the Magistrate's opinion, ive i the shares held by defendant in trust for plaintiff. The shares subsequently fell to little value.
