The statement of claim set forth that on February 2u. 1906, at Chicago, plaintiff entered into a contract with defendant for a concert tour of Australia and New Zealand that year; not less than forty concerts were to be given; and that on May 27, 1U0(I, defendant refused to carry out the contract. The defence was a denial that the contract had been entered into. The case has not yet been finished.
