S.M., f (>l . assaulting Mrs, l.olfc in a street fracas. i» May last (unstable* Watson and (lardiner were implicated, ad doubt was expressed as to tne identity of Mrs. Kolfe's assailant MT. and Mrs. Ilolfe saw Watson but tailed to identify him. The Magistrate concluded from other evidence that Gardiner was the assailant, and sentenced him to tn;ei|ty-oiie days' imprisonment, t.'ardiner then appealed. The conviction was all'irmed with .tin 10s costs
