COUNTY COUNCIL ACTION

ELTHAJI v. WAIMATE WEST. Amongst the business set down for at the sitting of the Supreme Court at New Plymouth, which opens to-day, is a claim by the Eltham County Council for payment of the &100 subsidy provided for in paragraph 4 of the Waimate Wvsfc County Hill, stipulating as under: — '"fck) long as the township of Opunake remains unconnected by a li*ie of railway open for traffic with the present line of railway betwevn New Plymouth and Wellington, the Waimate West County Council shall, during the month of October in every year, pay to the Eltham County Council thu sum of one hundred pounds." The Eltham County Council claims tue payment of the subsidy as from October of last year, and some time ago made a demand on the Waimate Council to m*et the liability. Ylw W<fimat P representatives. however, then took up the position that as the County was not formed till the Governor's assent was obtained and tlu» Gazette notice was published towards the end of November —.that no county was in existence in October of last year—the payment of the subsidy did not take effect till October of the current year.
