Preference is given to members of a union. The award will come mto force on March Ist, and endures for one year.

ARBITRATION COURT. Dunedin, l'jast Night. At the Arbitration Court to-day, the Inspector of Awards proceeded against Jolm Cooper and Francis Wadilell (Timaru) on II charge of attempting to defeat the provisions of the Otago_ shearers' award, and contrary to section 110 of the Conciliation and Arbitration Act, I'HkS, by inserting in the Otago Daily Times m November last, notifications advising shearers not to engage in shearing for less than ISs per hundred, all found. For the defence it was contended that no offence had been committed. The Court had fixed 10s 8d as the minimum rate, lint there was nothing to prevent a higher rate being paid. The Court decided that as respondents could not be, regarded as either workers or employers the case would be dismissed. The Court would not express an opinion on th: 1 question whether the advertisement was inimical to the provisions of the award, but the president saiil if such an advertisement appeared in future, and was* (he means of bringing about a strike, the gentlemen responsible for its insertion would be proceeded against. In the course of (he proceedings in the Arbitration Court the question of the dismissal of a man cropped up, and .Mr. Justice Sim pointed out that no employer was bound to keep an employee'. however competent lhaC employee might be, any more than a workman is bound to slay with ail employer.

STRIKERS FINED. Napier. Last Night. At the Hastings Magistralc's Court to-day. seventeen men were charged, on the informalion of the Inspector of Awards, that, being employed at Thos. liorthwick and Son's freezing works at Vakipaki. and being bound by the llawke's Bay freezing works' award, they did go on strike on January l.llh. The cases arose out of the recent difference between the manager and fellmongers as to the spell in the morning and in the afternoon in which to smoke. The request for "311101(0 oil's" not being granted, as such spell was not provided for in the award, the men in question ceased work in batches 0 f lives the fol'lowing morning. The men's demand iwas granted, there being a large amount of work on hand in (lie works. The men also insisted on an apology 'from (he nianiigcr for his action in culling tliein "cms." Mr. E. E. .McCarthy. S.M.. after hearing Ihe evidence, said it was clear (a him that the men bad'ail 'combined and decided to go out r.i ■bii'tchcs of fives. He considered that ■what occurred was a strike.
