STRUCK ON THE HEAD.
A CARTER AWARDED DAMAGES. liy Telegraph.^-Press Ansoclatiou. Wellington, Last Night. The hearing was concluded by Jlr. Justice Chapman to-day in the claim of tIoOU by Henry Smith, of Kilbirnio, I contractor, against Sanders Bros., eouI tractors. According to the ease for the j plaintiff, the defendants on 22iid April, 1008, were engaged on a contract for the erection of a brick building in Ballaneestreet for the Civil Service Club. The plaintiff carted the bricks to the building. Wliilst unloading his cart at the site of the contract he was struck 0:1 the head and severely injured liv a brick which by the alleged negligence of the defendants, or their servants was permitted to fall from the building. One medical witness deposed that plaintiff was suffering from traumatic neurasthenia, and two of them were agreed I hat it would he a year or more before lie was well. Evidence for the defence was given by Dr. Wallace .Mackenzie, who (leposed that he was unable to liml any trace of disease in the eye or any sign of iiiU-rpraiii.il trouble. Oenerally speaking, had there been any intercranial trouble, it would have been localised by this time. Witness did not think that plaintiff was suffering from traumatic neurasthenia. In answer to .Mr. Wilford witness stated lie would not deny that plaintiff might suffer giddiness when stooping,down. His Honor awarded .t2j<> damages.
