The Okato Club appealed on the ground that D. O'Sullivan, who played for Opunakc, lived within the boundaries of the Pihaina Club, and was not entitled to play for Opunako. The case was a complicated one, the evidence showing that O'Sullivan apparent I v lived for half of each week in the Opunakc district and for the othnhalf in the l'ihaina district. One of ilia w itnosses submitted si declaration swo:'n before a .I.l'. that be had seen O'Sullivm working on his father's farm in the i'ihaiiia district on an average of four days in each week from lib .Mav to 2!lth June. O'Sullivan, however, refused to sign a declaration I.lml lie resided in th" Opunakc district. A similar protest was received from Hie I'ihama Club.
