Nellie Whelau, barmaid, said Andersen and Haakonsen tame to the Empire Hotel at 8.5 p.m., returned' to tJi« theatre, and, accompanied by Hansen came back to the hotel about 11.13 p.m! She had previously told the police she did not know tin; time, not wishing to be mixed up in the case, oiie saw no blood on the two prisoners, Peter Hobb gave evidence about the fish shop row and also a fight with stewards later. One of the stewards was drunk and was knocked down by Halineu. Mrs Shaw said she saw the three men in the theatre at the time it was allcg-; ed Uiirke was murdered. Two witnesses sw Conelly after Burke's body was taken away. It was stated that liurke was killed with; a knife, not by a blow. Wm. Thomson stated that Conelly was on board the steamer, returning to: Westport for the Nelson trial. He asked hiin not to mention that he had seen him at Paparoa. Witness added that Conelly swore falsely in stating he did not know liurke before, as Burke was at Blackball a year ago and used to play his accompaniments. The prosecution is still unfinished.
