THE WIRE NETTING CASE.
IJIUIi COURT'S DECISION
Received May 22, 0.55 p.m. Sydney, May 22, The High Court has given its decision in the famous wire netting case arising out of the seizure in August last, by the authority of Mr, Carruthcrs, then Premier, of a consignment of wire netting imported by the State Government without paying Customs duty thereon. The main ipiestion involved was whether the States, were liable under the Federal Customs Act to pay duty on goods they themselves imported. The Court tiiianimously found the Customs Act applied to the goods imported by Governments of the Sta-tes. The removal of the wire netting, the Court held, wits illegal, and there was not a defence to this action. Counsel for the Commonwealth asked only for the imposition of a minimum penalty. Judgment was entered for plaintiff for £5.
