During the hearing of a charge of assault against Constable Douglas, of Hikurangi, a scene occurred between Magistrate Dyer and solicitor Hacked, of Auckland, who was appearing for informant. J). McLeqd. The latter had been put oil' the racecourse by the constable, who was acting under the instructions of (he Racing Club to refuse admittance to unlicensed bookmakers. In questioning the constable, Mr.. Hackctt tried to get a positive answer as to whether the constable had direct authority of the club for his action. Mr. Dyer to Mr. Hackctt: You are wasting 'the time of the Court, as you always do. Mr. Hacked: Am I not allowed to question a witness in my own way'/ Mr. Dyer: Will you proceed'; Mr. Hacked: 1 will proceed in a proper wayl Mr. Dyer: will proceed according In my instructions! Mr. Hacked: 1 will not be intimidated by yon. Mr. Dyer: If you use the word "intimidated" again I will put you where von will Ih' kept quiet! ' Mr. Hacked; I repeat I will not lie intimidated. Mr. Dver (hcatcdlv): Sit down! Mr. Hacked: I 'will sit down presently. .Mr. Dver (verv heatedly): Sit down! Mr. Hacked: I can only ask permission to withdraw from the case. Mr. Hackctt thereupon left the Court. The charge o[ assault was eventually dismi-sed. with costs CI 7s.
