THE LAW ON EVIDENCE.
Per Press Association. Christchurch, Last Night. A curious point of evidence arose during the hearing of a forgery case at the Magistrate's Court to-day. A man and a woman were jointly charged with forging the name of the woman's husband to a promissory note, and the husband was called to give evidence. Objection was 'raised by counsel for tho man oil the ground that his evidence was imulmissiijlt! without consent, as the offence was against the Crown and not one 11s between husband and wife. In such n case it would have been admissible by the Evidence Act, 1905, Air. May stud that the point had not yet received Judicial consideration. In Ms opinion there was to be an offence against the husband before the Crown could take action. Jn any ease, the evidence of the husband would lie ad- " missible against one of the parties, and " he therefore admitted it.
