SUPREME COURT.
Per Press Association. Dunedin, August 21. the Supreme Court to-day, John McMillan was charged with having, between October 15, 1897, and October 6 1905, stolen ,£llsl 18s 10d, this sum having been drawn in varying amounts out of the Funds of MeKechine and Fleming, of which accused was a partner. The lease occupied all day. Mr Hanloii, for defence, submitted that accused did not ,take the money with the fraudulent indent of depriving his co-partners, and that accused had every "color of right'' to take it. A verdict of not guilty was returned, and accused was discharged.

Accused was found guilty. On a second count of the indictment, certain questions were reserved for argument before the Court of Appeal. Pending decision on these points, accused was remanded on bail.
