Per Press Association. ■ Wellington, July 22. The Appeal Court to-day is hearing the motion of tile Canterbury Law So,cieiy to have the name of Frederick Fu.ler, barrister, struck off the rolls or to have him suspended on the ground of his failure to pay over money to a client and his failure to keep a trust account.

lu an affidavit Fuller admitted his failure to pay, but stated that the money ( £l4 12s) had been paid since and that ho had thought ho was entitled to retain it, as it had been received in connection, with tui estate he was setting. lit- denied that lie intended to retain it permanently. On behalf of Fuller, Mr Wiiford urged that a?> there was no dishonest intention. the Court should not make a rule abso ute. The proceedings wore a sufti cient lesson to his client, and hw would not be likely to make such a mistake again.

Norrdlterg, respondent, who was convicted of an indecent assault applied to the Appeal Court for a new trial on thp ground that the verdict was against the weight of evidence. lie also asked leave 1o appeal in forma pauperis, being a foreigner and having no means.
