Hughes, for residents in \lvlau street, petitioned the Council protesting against the proposed deviation of the lluatoki stream, which work was now proceeding. Mr Hughes said he had noticed th.it the borough solicitors had carefully abstained from advising the Council to proceed with the work, and lie thought that that would have been a sufficient "lilt to the Council to prevent the work going on. The pretty Huatoki stream had been turned from its course into a deep, ugly gash," and a notice board invited people to come and deposit rubbish there, and already this was beinc thrown in. Apart from this, the deviation could not be proceeded with except by Act of Parliament. l[r Hugh.'S contended th;it the stream was a public diaiu, and that under the Municipal Corporations Act anyone interfering with a public drain was liable to a line of £SOO, or in default twa month*' imprisonment. The properties overlooking tile land had suffered permanent damage, by the destruction of 'lie stream and its woody banks and the probable erection of buildings with msightly back yards, towards which residences would face in future. Jir Collett had promised the hand necessary for this, lie coulu not see how the Council have prevented the deviation, seeing that the work was all 011 private property. The Council, on the advice of its solicitors, had given no permission for the work goim* on. lie moved that the petition be ri° ierred to the Works Committee, and this course was adopted. GENERAL. ' On the motion of Crs. Colli* and Pikctt, tile Council decided ' not to repair streets after being opened by the Has Company, in order that the Company and not the Council would be liable in case of any accident resulting from the state in which a street was left at anv lime.
