Accused had stood its trial twice before, when the jury ■disagreed each time. William Thomas Felton was also acquitted on a charge of munslaughL-r Ly negligently driving a motor car along •the Kiccarton road on December sth. .The ear came into collision with a j Wavy cart, and Georgo Tancrcd dt Morlialk, one of tbe passengers in tin car, was killed. It was urged for the defenceftfhat die accused possessed all the akill tliat could be legally required of him, and he had not been guilty oi gross negligence.
