No evidence was called for the defence. Mr Solomon, in his address to the jury, pointed out thtf accused ,was charged with killing the woman, and the evidence showed that he did not kill her. Admitting that an instrument was used, Dr. Roberts said that, was not the cause of death, buti the introduocian of an irritating inaction subject, either liquid or solid, fie challenged the statement that an instrument was used by Hayne, and commented on the fact of the pri. soner not having been notified of the woman's death, and that the depositions were to be taken, and on the fjact of. the magistrate and doctos who took the depositions and were present, not being called. Justice Cooper, in summing up, said it was unfortunate that accused had not been notified that the depositions were to be taken. Ho could have attended personally, or by counsel, and possibly some statements ■now appearing would have borne a different aspect. ..The jury, afte r a retirement of ten minutes, returned with a verdict of "Not guilty," and accused was |charged.
