For the defence it was argued that it was not clearly proved that the child had been a.ive, and His Honor Ju-tice Denniston. in summing up. -aid that the home was shamefully understaffed, and it was abundantly clear that there had been a grobreach of duty. The jury retired shortly before 6 p.m.. but failed t.i agree, and wte di-charged.
