CASE BEFORE THE APPEAL COURT. ' '■ Per P.res? Association. Wellington, October 9. In the case, St. Hill and another y. St. Hill, to determine the meaning of certain provisions of the will of Ashton St. Hill (decoased), argument was no! concluded when the Appeal Court rose.. In 18SG St. Hill and his wife had separated, and he covenanted 10 pay her an annuity. In 1807 he substiiuted a deed, that in tho event of h : s wife surviving him, his executors should pay her £SOOO. In igoi testator directed that a legacy of ,63000 be given u> his wife i n lieu of die annuity. The question is whether the legacy of ,63000 was in addition *0 .63000 covenanted or not.
