The appeal was based pa the contention that the facts did not justify a conviction. ■ In the course of argumont, His Honor said the Legislature would, ho believed, spo.i alter the state of the law in regard to street betting. The Legislature ought to say that if any person who is a bookmaker, or a reputed bookmaker, wis found lounging about the streets with other people, the ouus must be thrown on him to show he is there for a proper purpose, failing which, il would bo left tj bu presume! ho was there for improper purposes. If a man day aficr day haunted streets knoivn to bo the lmunt of reputod bookmakers, and could show no apparent good purpose, His Honor would think it would be inferred he was a boakuirker.
