FAILURE TO CLEAN MILK-CANS.
DAIRYMEN HEAVILY FINED. Per Press Association. Auckland, August 10. A prosecution instituted by the [nspcetor of Dairies camo before Mr R. W. Dyer, 8.M., iu the police court to-day, James Wood and George E. Tansley, dairymen, being summoned for falling to thoroughly cleanse two cans used for the reception of milk. Mr S. Mays, on behalf of tho Crown Solicitor, stated that Wood and Tansley owned registered dairy farms at Otahuhu and Fanmurc, and kept a shop in Auckland. They collected milk from farmers in the morning and loft the empty cans along tho roads each evening. Two cans owned by defendants were concerned in the case. Tliey were delivered to one of the defendants' farms in an uncleansed condition, and were watched for the regulation four hours within which they should have been cleaned, but the process was not carried out. George Lang, manager of defendants' Otahuhu farm, stated that the cans brought in at night from Auckland were cleaned at 8 o'clock next morning. They were allowed to air till 5 o'clock, when they were again used. Mr Baume, for the defence, submitted that the case ought to be dismissed, because the cans concerned did not come under the regulations. The cans in which milk was "received, stored, or distributed " were specified by regulation as having to be cleansed within four hours, but the cans in question were used only for transporting milk from tho farm to Ihe dairy. He thought the court would recognise that Messrs Wood and Tansley's cans were clean when used. There was no provision for washing the cans in the town shop, and assuming tho journey to the farm lasted mora than four '_ hours, the regulations could not be , observed.
His Worship replied that if the regulation was unworkable, dairymen] a raid represent the matter to the heads of tho Department, when an amendment could be made. He was satisfied tho oans oarne within the regulation.
Mr Brown (Dairy Inspector) was called by the Magistrate anl stated tint the cleansing was easier if carried out within four hours.
Defendants we're jointly fined £lO, with £ll9s 6d costs.
