ALLEGED FRAUDULENT DECLARATION.

PBP PBEBB ASSOCIATION. | Dunedin, May 15. Tiic adjourned case in which the Collector of Customs prosecuted Ernest James Fenn, of Stewart and Fenn, electrical engineers, in respect to a declaration made as to the dutiable value of good«, was uontinued to-day before Ms W. G. Widdowson, S.M. The firm had ordered an electrical plant from the Brush Company, and when the invoice and goods arrived, the usual declaration was made as to tho value, the figures of the invoice being acoepted as correct. The Brush Company had since sent a declaration that the dutiable goods, instead of being of a value of £6O, have been valued at £l6O, the mistake having been made by their clerk. The goods were meantime detained and confiscated Evidence was given for the defence. Mr Fraser, for tho Crown, said the decl&ratiens were made by importers who had a speoial knowledge, and were the only people who had that knowledge. The man who said " I do not know " or " I never gave the matter a thought," was guilty of fraudulently concocting a scheme for defrauding the Customs. His Worship reserved his decision. On the information, under Section 213, the summons charging Fenn with being knowingly concerned in fraudulent evasion was dismissed, no evidence being called on it.
