Jlr Skelton held thut the Court had no jurisdiction in the case on the grounds that the vessel was not a nierchunt ship, but belongs! lo His Majesty ;■ the men employed thereon heing consequently under the control of His 1 Majesty. Mr W. J. Napier, who appeared for the prosecution, contended thut the. vestel was not under the control of His .Majesty, hut was controlled by the Pacific Cablo Hoard, and tlint the Court consequently hud j>owet to deal with tho caso.
