At the 'time of the accident Mr Bradley was advised to have the horse put in slings, but ] Mr Wood was against this. Mr Bradley eventually decided to leave the case entirely in Mr Wood's hands, and the Beg of the injured shoulder was merely slung (from the body. At tHe Magistrate's Court to-day, George Cooksioy and George Harris proceeded against Johnson and Sons, printers, fop alleged Infringement of copyright. Plaintiffs in the month of January purchased from the Wellington Racing Club, tor £l9l, the solo liberty of printing and publishing the official card to the races to be held at the summer meeting of the club. Defendants, without the consent oi plaintiffs', printed and published a book which purported to be the official book, and was, in fact, in its material parts a copy of the official book. Plaintiffs, therefore, sued as assignees of the Copyright, and claimed from defendants £IOO and double coats of the suit. Alternatively they sued ns assignees of the copyright in the design and pririted matter of the cover of the card, which cover was in its material details copied, printed, and published by tho defendants, Plaintiffs also alternatively sued defendants for that they printed and published race cards which they knew plaintiffs had acquired from tho Racing Club for a large sum of money, exclusive of the right to sell. Plaintiffs" total clnlm was limited to £IOO, whether they recover under nil or any of the alternate claims. Counsel for defendants raised a non suit point that the copyright had not been proved according to the conditions of sale. There was no exclusive right to publish, there was only tho right to print und issue the club's correct card. There were many dissimilarities in the two books, and there wus nothing to show the public had been deceived. His Worship said ho would give judgment on this point next, week, TRESPASSING ON A COURSE. (Per Press Association.) DUNEDIN, March 28. At the Magistrate's Court to-day a number of cases of trespass on the Wingalui racecourse were doalt with. Wm. O'Connor was lined £5 und £3 Is fld costs for not leaving the course when warned. Francis Oraw, who did not appear, was similarly lined. John R. Hunter was fined a similar amount on each of two charges, his counsel intimating that he would probably appeal.
