According to the evidence of the claimant, it appeared that defendant, who was- a contractor, engaged complainant as carpenter to remove a house from Wa Rekauri, and re-erect it at Waikjno. In order to reach bis work he was obliged to use a horse. One day lit noticed his horse apparently running away, and becoming frightened he was going to lose it, he rushed away from his work, and essayed to catch tfVj horse. Whilst running a rusty rasp ran into his foot, and as a result he was' laid up for seven weeks. lie claimed half wages for live weeks. In reply to His Worship, plaintiff said that when engagi there was no arran (plaintiff) was to use a horse, and that the latter was ridden to work as a matter of convenience.
