The young man Frank Smith, who was on Friday committed for trlul on a charge of »hee'p-:>teai'ihg, wus afterwords'! called upon to answer a, charge of assaulting Sergeant HaddjcU while in the execution of his -duty. | Sergeant Haddrell deposed that on January 7th ho went to ITurpy to arrest accused. In the evening- witness was in Mr Kamell's house, and saw accused coming along behind a gorge fence, in a crouching position. Acßusod then came into the house where witness was, and into the kitchen. Witness was in the bedroom with his boots oil. Accused 'opened the door ojf a room opposite to where witness stood, the latter pepping out behind him. Witness caught hold of his collar «nd salid, ,'" You need not trouble. Come nT long with me." Accused turned round and hit out with his iiui,, givfng nt. least ifour severe blows on the face. Witness was in mufti : but accused know him well. Ed afterwards started kicking and trying, to bite. He also jumped on ; walnesH' feet. I Geo. Kaniell gave evidence to tho effect that accused was, very violent?. I Accused was sentenced to two :months' hand labour.
