An Appeal Case.
WELLINGTON, August IS. Su-w. H. Kussoll and Messrs W H. Hemes anil O. Samuel, judges in tire appeal brought by the owner of Petrovna against tlio decision of the Canterbury Jockey Club, awarding the race to Mr Stead's horse l! u ,g~ Pipes, havo given judgment. Tho facts and cfuestiang to 'be decided were similar to those in the Gladsome appeal. Th« same apprentice rode Gladsome and Bagpipes, lie hold no license. Tho judges hold that a horse to bo a winner must fulfil the essential condition of being ridden by a licensed nidor, and tho loss of stakes ia a necessity consequence of his not having been rjddcn by one qualified to ride. The judges therefore allow tha appeal, and reverse Che decision of thcOamtcrtwry Jockey Club. They direct that tlio stakes paid to tho owner of Bag°pipes be refunded to the C.J.C, and paid over to tho person entitled to Uiem had Bagpipes not started.
