In the Mount Eden gaol case plaintiff's evidense waa lurnished to-day with tte, testimony di two prisoners, both of whom deposit! to seeing O'--KeiUyprod Jay in the back with his , knee., Mr J. C. Martin, in opening the case for Warder O'Reilly, said the Police Department wished to obtain . Jay's photo to compare it with an photo, and on Jay objecting, the authotities communicated .with headquarters, after which o'Eeilly was instructed to use force it "." •"necessary, even to the extent of handcuffs. Q'ReiUy denied that Jay was hurt by the handcuffs or that he kicked him. He asserts that he merely levered Jay with his knee to compel Mm to straighten up -before the photographer!
