A Pecullar Case.
(Per Press Association). PALMEUSTON N., March 28. An interesting ease! was heard here Hobday when a prosecution was instituted against a settler who had been arrested at dead of night for cutting a wire fence enclosing McHardy Bros.' property. The defence was that the fence encroached on defendant's property. The Magistrate dismissed the case on the ground that ' defendant thought he was acting under the bona lidc belief that he was >rithin his rights. -* A test case will be taken to the Supreme Court.
