Important Land Sale.
(Per Press Association.) CHRISTCHURCH, Nov. 20. At the Supreme Court to-day an action was begun by S. K. Garrick against James Copland for specific performance and damages. Plaintiff alleges that on July 7 defetidcnt sold him the Heslcrton estate of 11,972 acres freehold for £26,000 through H. Maitson and Co. On July BO du'endant gave notice repudiating the contract- Plaintiff had Already sold the whole contract in lots to various purchasers. The statement of defence denies the claim entirely and alleges that on June 20 defendant instructed Matson and Co to sell the property in lots. On July 7 they informed him of an offer for loto a 4 and 5, but he refused 1o sell these without the rest. They suggested that Garrick; a brother-in-ia'.y P? members of the firm and iri their employ, would buy the whole property 1 and finally the sale was affected at Leicester Matson's house, late on the 'evening of Jiily 7; James ijocdmah 'drawing up the agreement whereby defendant sold to Oarrick for £2(.1,000. Hearing that Matsons had had offers for Mocks other than 3 ( 4 and 5 when they induced him to' sell tli Garrick;the defendant repudiated the contract oil the grouhdhd that Matsons made fraudulent representations to hirm The evidence of Goodman tird defendant occupied the whole of the day and the case will bo continued tomorrow.
