A BANKING QUESTION.
PKK PBKSS ABSOLUTION. Wellisgtoh, Februiry 3. Mr Justice Edwards gave his decision this morning on the law points in the ease of G. W. Banks v. the Bank of New ZaaUsd, a claim for £IOOO damages for dishonouring a cheque. Plaintiff instructed his clerk to pay in £137 to his account. The clerk made out a pay-in slip in the wrong name, but the accountant of the bank gave a receipt as though the money had been paid to plaintiff s account. The mouey was not put to his account, and when achepue wa/» present* i it was dishonoured. Sis Honor held that oa the law poiut--, the neglect was on the part of plaint: if 8 cork and not am the part of the.bank, which was not compslltd to show that the receipt corresponded to thep.iy-in a! ; p.
