Plaintiff in October purchased from defendant twelve bushels of Taitarhnse d oats, but was supplied with Danish, and be ol»i»n«d £lO damages. In giving judgment, the Magistrate said the • vidence ilsc'i's •' th»t unly Tartarian oats could he profitably sown on plaintiff's farm 83 late in season. The l'artarian crop would havA b en 2£ tons per acre, whereu the yield was only threequarters of a ton.
