AN IMPORTANT CASS. FEB PBEBS ASSOCIATION. Wellington, March 26, The Court of Appeal reserved judgment in the case of Hannah y. (Jommistioner of Stamps, involving a question of liability in certain transactions to deed of gift duty. The Oourt then heard tbe argument in an important matter of a t-ummocs taken out by tbe Wellington City Corporation calling upon the District Land Registrar of Wellington to substantiate tbe grounds of his refuail to register certain transfers to the corporation of land acquired far stre.t widening purposes. The question r-us«d is as to the construction of section 20 of the Public Works Act Amendment; Act, 1900, requiring the owner on subdividing his land for the purposes of sale to provide a frontage to the street 66 feet wide for rach allotment. The corporation acquired, in each case before the Court, a portion of the holding, the selling owner retaining the remainder. The Registrar refused registration, because the frontage mentioned by the Act was not provided for. The question involved is whether the section applies in every case whero an owner sells a single portion of his holding, or only nkere land is cut up into a number of allotments for sale. Mr Martin appeared in support of t he rummon?, and Mr Chapman for the .Registrar. The Oourt reserved its decision, and adjourned to 7th April for delivery of judgment.
