Osborne was a member of Oourt yianawatu, A.0.F., and his ehild was being attended by Dr Mclntyie, one of the lodge surgeons. The latter, however, broke his leg and asked l)r Wilson, the other surge' n to the lodge, to attend the patient. He did so, and ordered the child's removal to the hospital. Later on he sued Osborne for £29 18s 6d meaical fees, and the Stipendiary Magistrate gave judgment for £l3. It was against this decision that the appeal was now bi ought. Council for the appellant intimated during the hearing of the case, that though the parties were primaiily Osborne and Wilson, he appeared on behalf of the AncieDt Order of Foresters, as the matter was of great importance to the Society. He contended that under the agreement entered into the surgeon had to attend the families of all members of the lodge for payments agreed upon, and was cot allowed to make a private or special charge; that when Dr Mclntyre was disabled, thtt lodge member* under his charge were entitled to claim the services oE ihe other lodge Burgeon; that by agreement, rules, and statute th« matter was a dispute determinable by a special tribunal, under the Act or agreement, so that tho magistrate had no jurisdiction.
