CHINAMAN AND TROOPER.

I FSB ?888 ASSOCIATION. 1 Wellington, January 28. 1 The Stipendary Magistrate was en-l gaged during the afternoon and all the] evening hearing the charge of assault] against Private Leonard Jacobs, a] member of the Eighth Contingent. It appears that on Saturday afternoon accused, in company with two other persons in khaki, and a civilian, went to Haining-street, where Jacobs had a scuffle with a Chinaman, who was removed to the hospital suffering from a severe wound on the head and two broken ribs. It was alleged that accused bad thrown the man down, knelt on him, dragged him about by the pigtail, struck bin on the face, and genetally treated him in s brutal manner, Evidence wss given by persons who saw the assault to this effect. For the de* fence it was stated that accused j beckoned to the Chinaman, whose immediate answer was some foul language, and a rush at Jacobs with a small axe Jacobe, finding himself thus assailed, had clossd with the Obinaman and dis-1 armed him. It was admitted that accused bad been drinking before the assault, but not sufficiently to place him under the influence of liquor. At 11 p.m., the Magistrate remanded the accused on bail until Thursday. The lata sitting was to allow several military witnesses to leave by the troopship tomorrow.
