S'an ford, S.M., w.th discharging rifles in 4 the Waitara Hotel on the niftfit of! Novpra'-er 11th. Fdrquhar pleaded guilty to firing at a lamp. Mr Weston appeared for Kienner, who pleaped not guilty, and sta'ed he was merely explaining the mechanism of the breech when a blank cartridge, which must have bßen left in the rifle, exploded and caused an injury to the barman. The Magi trata inflicted a fine of 10j and costs on each defendant. Sargeant Haddrell prosecuted. Kienner was then charged with behaving in a manner calculated to provoke a breach of the peace; also with assaulting Robert Mascall with a rifle. From the evidence it appeared that Mas a'l and some friends from New Plymouth were in the bar of the Waitara Hotel after tea on the night of the King's b rthday, when a question arose as ti a billiard match. Defendant was-also present, and used abusive language, callng the others a " lot of speilers." Shortly afterwards, outside the hotel, Kleuner went for Maxwell with his rifle, and following him up, struck at him with the clubbed rifle. Maxwell received the blow on his arm, and closed with defendant, who was then disarmed, getting severe treatment during the operation. Mr WfS'on, on behalf < f defendant, urged that he had ixen cartied away by the excitement of the sham-fight that day. Mascnll was charged wi h ai-sulting Kienner, but the charge was dismissed, his Worship expressing an opinion that defendant had only used legitimate force in self defence, and was perfectly justified ia his treatment of Kienner.
