[MB PRESS ASS»OIATIOX.] Wellington, October 10. In the Appeal Court, thecueof Moore v. Public Trustee was commenced. Mr Findlay appears for appellant, and Mr, Theo. Cooper for respondent. The question involved was the-validity of deal ings in certain native lands in T ranaki. Shortly after tho commencement, the case was .adjourned till-to-mo:row to enable counsel for' respondent to.consider whether he would abandon opposition to the appeal. The case, Macawatu Railway Company versus McLood, was commenced. This is an appeal from the Chief Justice giving judgment for Moore, an engine driver, on the jury's findings, and damages for injury to sight by glstfs from a window broken by a brick falling in a tunnel. The main questions involved are v/hether the Employers' Liability Act does net prevent an action at common law, and whether plaintiff did not knowingly incur risks.
