i [FEB PBESS ASSOCIATION.] Dunedin, May 17. A test cas9 was heard under the Factory Act by Mr. Carew, S.M., today. Informations were laid against several manufacturers for failing to pay wages to employees in respect to i a statutory half-holiday, and a case against the manager of Messrs. Hallenstein Bro3. was taken as a test on it. It was repeatedly explained that there was no desire to avoid payment of a just claim, but thoy simply wanted a decision. It appeared that at the Easter holidays the manufacturers closed tbeir places on Thursday and re-opened on the following Tuesday, no work being done on Saturday. Payment for that day was stopped, the contention being that as they had not been employed on the five days preceding that day there was no claim to half a day's wages. The whole point i< the reading to ba placed on Section. 63 of the Factories Act, 1894. As the matter was of importance, and affected every factory in the colony, Mr. Carew took time to consider his decision.
