When the Supreme Qourt, at Wellington adjourned yesterday after the second day’s hea.'ng of the five charges against. Harold Fairchild Pobar, agept, Bertram Egley, company secretary, and Hannath Noel Blake Marshall, company director, 11 of the 27 witnesses to be called by the prosecution had been heard. The others will bo heard to-day and to-morrow. The principal charge against, the three men is that they conspired with one another between June 22, 1935, and March 31, 1936, to defraud such persons as should be induced to purchase tickets in a skill test competition by falsely representing that a car was available as a prize without disclosing the fact that it w'as subject to a.n. instrument by way. of security securing the principal suni of £450, and by falsely representing that the car was. new and was being kept sealed. Four-charges of obtaining sums of money by the same false pretence also are laid. Accused deny all the charges. Mr Justice Johnston is on the bench. The prosecution is being conducted by the Crown prosecutor, Mr W. H. Cunningham, who has with him Mr C. Evans-Scott.. Pobar is not represented by counsel, and is conducting. his ojyn defence. Mr H. F. O’Leary. K.C., with him Mr T. P. McCarthy, appears for Marshall, and Mr A. H. Macandrew for Egley.
