P. , Hoit'e, J. Wakefikld, and others of the No. G COMPANY RIFLE VOLUNTEERS. Gentlemen, —When I had the honor to enrol myself with you at the formation of the above Company, it was under a sense of duty to my country in the true volunteer spirit, indeed to take part with you in an organization under her Majesty; and to defend our homes and her laws was to me a very agreeable task. Up to the 24th of August last (the day of the funeral of the late Mr. Kite) I had never unlawfully absented myself from drill, and to this day, although unable to attend the parade myself, I encourage others in my family and service to do so in my time and at my expense. But, Gentlemen, I have a grievance to lay before you. On the 17th August a law was proclaimed that "leave of absence in future would not nor could not be granted, except in case of sickness.' 1 On the next drill da}', 1, having more respect for the dead than I had or ever can have for the law of the seventh, absented myself for the first time (of course) without leave. The two drill days following, viz., 3let, and September 7th, I was unwell and unable to attend ; for the 14th I had no valid excuse to make; but the remainder of the month and that of October, my wife was very dangerously ill, requiring and having my constant attendance. Being placed in tliis position, and by the above l«w to a comulsory drill, I was bound to neglect the one or the other—l chose the latter. For this 1 was vi.-ited with two fines in August, four in September, and three in October, amounting to £3 12s. Thisl regarded as being unreasonable and unjust, and 1 refused to pay it; but as nothing else would satisfy the Captoin, I was summoned before the Magistrate's Court, Nelson (a Court which had no power to deal in the case), and was ordered to pay the amount, but recommended to see the chief officer on the subject. After paying expenses I left the Court and thought for shame no man would ever hold up his hind for anything more. In this I was mistaken, for 1 have Miice had another visit from the Captain in search of the cash—upon which occasion I gave him to understand that unless it washy the wish of the Company, I never could consent to pay it; and that if he chosj to tike it, before he had submitted the case to them, it alljwed me an opportunity to do so, that I should only regard it as an injustice. This could not be heard, so 1 was forthwith distressed, and being ftom home at the time 1 was advised to have the money paid (under protest), which I did, as being the price of liberty. Hut the worst has yet to be told. In the Colonist of December 7th will be found a report of the case as it came before the Court, note the evidence ! In answer to a question put by myself, the Captain said that he " refused to grant" mo " leave of absence on the 3rd of August." Now had this been true (placed as he knew 1 was, on the very busiest day of wheatsowing and the weather so catching as it was,) it would only tend to shew the injustice more clearly; but he did grant me leave, and that too before witnesses. Again: it was affirmed that 1 " was not at drill on the 17th." Had he not been there himself and drilled me on that day 1 might have thought that he had been misinformed, but such was the case, it was also stated that " there was no drill on the day of the funernl of the late Mr. Kite." He might not huve been there himself, but those who were there could not be so mistaken. And before he left the witnessbox he said that he "did not believe" in my wife's illness ; but, those who attended her sick bed night and day for five weeks know better. Gentlemen, I have here stated the simple facts of the case, and can only add that it would give me great pleasure to have an opportunity to meet you in the presence of Captain Sparrow and his superior officer to substantiate the same, 1 am, Gentlemen, Your Obedient Servant, THOMAS BUTLER.
