SIR,— I am instructed by Mr. Travers, the District Judge, to call your attention to a paragraph in a letter addressed by you to the Colonist newspaper, and published in that paper this day. The paragraph in question is as follows:—" But what can the Editor mean by 'leading the defendant to acknowledge his imputations to be unwarranted by the facts and contradicted by the evidence?' I think it quite possible, Sir, nay probable, that had the defendant-" different witnesses been placed in the box, and carefully examined, I say, that it is quite possible that such 'Facts' might have been brought to light that would make even the Examiner blush before asking Mr. Saunders to eat his words." Sir. Travers looks upon this paragraph as a reiteration of the charge made against him by Mr. Saunders, and has directed me to institute legal proceedings against you, unless on or before Friday morning next, I "receive from you a retraction of, and apology for the charge, with authority to publish it at your expense in tbe local papers. I am, Sir, Your obedient servant, SAMUEL KINGDON. To Mr. Thomas Butler, Richmond. Richmond, February Bth, 1860. Sir,—l beg to acknowledge the receipt of your letter, dated 7th February, 1860, in which you (on behalf of Mr. Travers) request me to make an apology for a paragraph in my letter to the Colonist newspaper, published on the 7th instant, which your dient considers a reiteration of the charge made against him oy Mr. Saunders. My only intention in publishing the letter in question was to comment upon the leading article of Saturday's Examiner. In doing so I had no design for endorsing the libel of Mr. Saunders; neither did I intend it in any way to reflect upon Mr. Travers. As he regards it in the light of a reiteration ofthe charge which a well qualified jury has considered unfounded, I can only repeat that he has entirely misunderstood me, and 1 therefore apologise to him, if in any way I have, contrary to my intention, seemed to make any reflection upon him. You have my authority for publishing this. I am, Sir, Your obedient servant, THOMAS BUTLER. To Mr. Kingdon, Solicitor, Nelson. 155 ioknimerf jfofoe, POST OFFICE, NELSON.
